Puppy Purchase Agreement
All sales are considered
initiated, transacted and finalized in Island County, WA.
The following agreement is
between, Deborah Mitchell (breeder) of D’Tresors Kennels, PO Box 993,
Coupeville, WA 98239, phone (360) 678-1417, email: deborahjay2003@yahoo.com, hereafter
referred to as “Seller,” and

In consideration of a
purchase price of $ ___ .00 of which 10% is non-refundable, the
Seller transfers all rights, privileges and responsibilities associated with
the ownership of the following puppy to Purchaser as specified below. A deposit of at least $200 may be put down to
hold a specific puppy. The balance is
due in cash at “pick up” time. Shipping
charges, crate, health certificate & travel are additional and optional.

Health Guarantee:
I hope that you will enjoy
your puppy for years to come. I have
taken steps to ensure that your new puppy is healthy. Your puppy has been selectively bred for
quality, health, soundness, intelligence and good temperament. All puppies will be current on vaccinations,
tails docked (unless other arrangements were made with Purchaser), dew claws
removed and will have been regularly dewormed at the time of sale. Any umbilical hernia will engender an
automatic $50 reduction in the overall cost of the puppy, no further adjustment
or refunds will be made for an umbilical hernia.
The Seller guarantees the
puppy to be in good health at the time of delivery. In the unlikely event that there is a problem
my guarantee follows:
What’s covered:
My puppies are guaranteed
against life threatening congenital (birth) defects within one year from
birth. It is very rare for a problem to
arise after the pup’s first birthday. My
guarantee does not include poisoning, accidents, or behavioral problems, as
training philosophies and environments vary among individuals.
What’s Required:
_________New owners are
required to have the puppy examined by a licensed veterinarian within 3
business days of receiving the puppy. I,
as the seller have already provided current puppy shots and at least three
wormings for your pup (as noted in the medical history you received with the
pup). I require you to keep your pup on
a vaccination schedule (as delineated on your puppy packet cover sheet) and
routine wormings. Failure to have puppy
examined invalidates the coccidia/giardia portion of this contract.
_________Purchaser must
recognize that intestinal parasites are not uncommon in puppies and very often
appear during a puppies’ early development due to their immature immune system. I go to every length to prevent intestinal
parasites in my puppies. However, the
Purchaser must realize that in a previously asymptomatic puppy, the stress of
going to a new home and travel can actually result in the appearance of
intestinal parasites after the puppy leaves.
To that end, should the puppy manifest intestinal distress caused by
giardia or coccidia diagnosed by a veterinarian (in writing on letterhead) and
within 2 weeks of the pickup date, the seller will refund the cost of medicines
to treat those protozoa (for the period of accepted medical treatment for the
initial outbreak). This does not include diagnostic tests or veterinarian office charges.
What will be done:
If the above requirements
have been met, you may choose a replacement pup (of equal quality), buyer pays
shipping, from any of my litters (within 6 months) subject to availability,
paying the difference in price if you desire a more expensive puppy.
Return of animal:
Purchaser may return a puppy
for any reason; however, there is a sliding scale of refund - the purchase
price minus 10 to 50%. Up to 10 weeks –
10%, 11 weeks – 20%, 12 weeks – 30%, 13 weeks – 40%, 14 weeks to 6 months –
50%. If the puppy has been damaged or
suffered due to lack of care, the refund will be further reduced by the cost of
treatment. This refund price may
be adjusted if puppy is resold for a greater amount than the refund. This is good until the puppy is 6 months
old.
If your puppy develops a
life-threatening defect (such as heart or other organ problems) during its
first year of life, it may be returned for a full refund or an exchange for a
puppy from another litter (within 6 months).
________Under no circumstances will a refund be given without the return of the
animal.
________Purchaser agrees to
return the animal, without recompense if older than 6 months, if they are
unable to care for it and unable to find an appropriate home. Under
no circumstances will a D’Tresors dog be surrendered to an animal shelter.
I do NOT guarantee size or
fitness for breeding.
VETERINARIAN AND SHIPPING COSTS ARE NON REFUNDABLE.
UNDER NO CIRCUMSTANCES WILL ANY MONEY BEYOND THE
INITIAL COST OF THE PUPPY BE RETURNED TO THE SELLER.
This is a legal and binding
agreement between Seller and Purchaser.
This contract will be enforced and buyer will be responsible for any
legal expenses (i.e., attorney fees, court costs, etc.), regardless of where it
is signed. If Purchaser wishes to take
legal action regarding this contract, they are responsible for all legal
expenses (i.e., attorney fees, court costs, etc.) for both parties. Purchaser and Seller agree the proper venue
for any legal action terms and conditions of this agreement shall take place in
Island County, Washington.
